As of September 30, 2008, HUD employed 116 (1.19%) Individuals with Targeted Disabilities (IWTD). In order to have met the federal 2% participation rate goal, 196 IWTD were needed. This represented a decrease of 10 employees from FY 2007 and a decrease of 23 employees since FY 2004. The participation rate for FY 2007 was 1.31% and for FY 2004 was 1.36%. Over the 5-year period HUD had a net decrease of 0.17% in employees with targeted disabilities.
I. Counseling
HUD timely processed 96% of the 149 pre-complaint counselings (without remands) completed in FY 2008.
II. Bases of Complaints Filed
The bases of alleged discrimination most often raised were: (1) Reprisal; (2) Age; and (3) Race (Black/African American). Of the 98 complaints filed at HUD, 35 contained allegations of race (Black/African American) discrimination, 10 contained allegations of race (White) discrimination, 5 contained allegations of race (Asian) discrimination, 2 contained allegations of race (American Indian/Alaska Native) discrimination, 17 contained allegations of color discrimination and 25 contained allegations of disability discrimination.
III. Complaint Processing Times
Of the 35 completed investigations, 40% were timely. HUD's average time for completing an investigation was 275 days. Of the agencies completing 25 or more investigations, the U.S. Postal Service had the lowest average of 103 days.
HUD's average processing time for all complaint closures increased from 318 days in FY 2007 to 353 days in FY 2008. The government-wide average was 336 days.
IV. Costs
HUD agreed to pay $233,215 for 9 pre-complaint settlements, of which 3 were monetary settlements averaging $77,738. HUD expended a total of $66,125 for 35 complaint investigations, for an average expenditure of $1,889.
HUD agreed to pay a total of $354,472 plus other benefits for 24 complaint closures through settlement agreements, final agency decisions, and final agency orders fully implementing AJ decisions. For the 6 complaint closures with monetary benefits, the average award was $59,078.
