Targeted Disabilities

As of September 30, 2008, DOL employed 188 (1.22%) Individuals with Targeted Disabilities (IWTD). In order to have met the federal 2% participation rate goal, 308 IWTD were needed. This represented a decrease of 5 employees from FY 2007 and a decrease of 18 employees since FY 2004. The participation rate for FY 2007 was 1.25% and for FY 2004 was 1.3%. Over the 5-year period DOL had a net decrease of 0.08% in employees with targeted disabilities.

EEO Complaint Processing

I. Counseling

DOL timely processed 100% of the 177 pre-complaint counselings (without remands) completed in FY 2008.

II. Bases of Complaints Filed

The bases of alleged discrimination most often raised were: (1) Reprisal; (2) Age; and (3) Sex (Female). Of the 133 complaints filed at DOL, 31 contained allegations of race (Black/African American) discrimination, 12 contained allegations of race (White) discrimination, 4 contained allegations of race (Asian) discrimination, 1 contained an allegation of race (American Indian/Alaska Native) discrimination, 18 contained allegations of color discrimination and 34 contained allegations of disability discrimination.

III. Complaint Processing Times

Of the 97 completed investigations, 61.9% were timely. DOL's average time for completing an investigation was 230 days. Of the agencies completing 25 or more investigations, the U.S. Postal Service had the lowest average of 103 days.

DOL's average processing time for all complaint closures decreased from 599 days in FY 2007 to 553 days in FY 2008. The government-wide average was 336 days.

IV. Costs

DOL agreed to pay $9,900 for 4 pre-complaint settlements, of which 2 were monetary settlements averaging $4,950. DOL expended a total of $284,980 for 97 complaint investigations, for an average expenditure of $2,937.

DOL agreed to pay a total of $481,469 plus other benefits for 34 complaint closures through settlement agreements, final agency decisions, and final agency orders fully implementing AJ decisions. For the 28 complaint closures with monetary benefits, the average award was $17,195.
