Targeted Disabilities

As of September 30, 2008, ARMY employed 1,714 (0.67%) Individuals with Targeted Disabilities (IWTD). In order to have met the federal 2% participation rate goal, 5,134 IWTD were needed. This represented a decrease of 5 employees from FY 2007 and an increase of 4 employees since FY 2004. The participation rate for FY 2007 was 0.71% and for FY 2004 was 0.75%. Over the 5-year period ARMY had a net decrease of 0.08% in employees with targeted disabilities.

EEO Complaint Processing

I. Counseling

ARMY timely processed 82.8% of the 2,312 pre-complaint counselings (without remands) completed in FY 2008.

II. Bases of Complaints Filed

The bases of alleged discrimination most often raised were: (1) Reprisal; (2) Race (Black/African American); and (3) Age. Of the 1,216 complaints filed at ARMY, 304 contained allegations of race (Black/African American) discrimination, 99 contained allegations of race (White) discrimination, 15 contained allegations of race (Asian) discrimination, 7 contained allegations of race (American Indian/Alaska Native) discrimination, 143 contained allegations of color discrimination and 294 contained allegations of disability discrimination.

III. Complaint Processing Times

Of the 514 completed investigations, 55.1% were timely. ARMY's average time for completing an investigation was 207 days. Of the agencies completing 25 or more investigations, the U.S. Postal Service had the lowest average of 103 days.

ARMY's average processing time for all complaint closures increased from 255 days in FY 2007 to 263 days in FY 2008. The government-wide average was 336 days.

IV. Costs

ARMY agreed to pay $128,314 for 262 pre-complaint settlements, of which 20 were monetary settlements averaging $6,415. ARMY expended a total of $3,312,350 for 514 complaint investigations, for an average expenditure of $6,444.

ARMY agreed to pay a total of $3,122,126 plus other benefits for 483 complaint closures through settlement agreements, final agency decisions, and final agency orders fully implementing AJ decisions. For the 181 complaint closures with monetary benefits, the average award was $17,249.
