As of September 30, 2008, NASA employed 173 (0.93%) Individuals with Targeted Disabilities (IWTD). In order to have met the federal 2% participation rate goal, 372 IWTD were needed. This represented a decrease of 5 employees from FY 2007 and a decrease of 17 employees since FY 2004. The participation rate for FY 2007 was 0.96% and for FY 2004 was 0.99%. Over the 5-year period NASA had a net decrease of 0.06% in employees with targeted disabilities.
I. Counseling
NASA timely processed 90.6% of the 96 pre-complaint counselings (without remands) completed in FY 2008.
II. Bases of Complaints Filed
The bases of alleged discrimination most often raised were: (1) Reprisal; (2) Age; and (3) Disability (Physical). Of the 56 complaints filed at NASA, 15 contained allegations of race (Black/African American) discrimination, 7 contained allegations of race (White) discrimination, 1 contained an allegation of race (Asian) discrimination, 5 contained allegations of color discrimination and 23 contained allegations of disability discrimination.
III. Complaint Processing Times
Of the 40 completed investigations, 95% were timely. NASA's average time for completing an investigation was 185 days. Of the agencies completing 25 or more investigations, the U.S. Postal Service had the lowest average of 103 days.
NASA's average processing time for all complaint closures increased from 301 days in FY 2007 to 358 days in FY 2008. The government-wide average was 336 days.
IV. Costs
NASA agreed to pay $8,500 for 19 pre-complaint settlements, of which 3 were monetary settlements averaging $2,833. NASA expended a total of $156,605 for 40 complaint investigations, for an average expenditure of $3,915.
NASA agreed to pay a total of $175,079 plus other benefits for 14 complaint closures through settlement agreements, final agency decisions, and final agency orders fully implementing AJ decisions. For the 7 complaint closures with monetary benefits, the average award was $25,011.
