As of September 30, 2008, TVA employed 54 (0.47%) Individuals with Targeted Disabilities (IWTD). In order to have met the federal 2% participation rate goal, 232 IWTD were needed. This represented a decrease of 8 employees from FY 2007 and a decrease of 25 employees since FY 2004. The participation rate for FY 2007 was 0.52% and for FY 2004 was 0.61%. Over the 5-year period TVA had a net decrease of 0.14% in employees with targeted disabilities.
I. Counseling
TVA timely processed 100% of the 83 pre-complaint counselings (without remands) completed in FY 2008.
II. Bases of Complaints Filed
The bases of alleged discrimination most often raised were: (1) Reprisal; (2) Age; and (3) Race (Black/African American). Of the 46 complaints filed at TVA, 11 contained allegations of race (Black/African American) discrimination, 3 contained allegations of race (White) discrimination, 1 contained an allegation of race (American Indian/Alaska Native) discrimination, and 11 contained allegations of disability discrimination.
III. Complaint Processing Times
Of the 37 completed investigations, 100% were timely. TVA's average time for completing an investigation was 110 days.
TVA's average processing time for all complaint closures decreased from 587 days in FY 2007 to 244 days in FY 2008. The government-wide average was 336 days.
IV. Costs
TVA agreed to pay $52,235 for 12 pre-complaint settlements, of which 3 were monetary settlements averaging $17,411. TVA expended a total of $112,833 for 37 complaint investigations, for an average expenditure of $3,049.
TVA agreed to pay a total of $98,143 plus other benefits for 5 complaint closures through settlement agreements, final agency decisions, and final agency orders fully implementing AJ decisions. For the 3 complaint closures with monetary benefits, the average award was $32,174.
