Amicus curiae literally means “friend of the court.” EEOC will consider filing an amicus brief on behalf of a private party in a case that raises novel or important issues of law under Title VII, the ADEA, the EPA, the ADA, or GINA. EEOC’s amicus program is focused on cases in the U.S. Courts of Appeals, but we will consider filing an amicus brief in district court or state court if the case presents a particularly important issue that falls within EEOC’s expertise. EEOC does not generally participate in cases raising primarily factual issues. EEOC will not file an amicus brief in a case involving a federal defendant.
EEOC has a lengthy approval process for amicus participation, and so it is critical that any suggestion for EEOC amicus participation be made as early as possible. Submissions should include the case name, docket number, circuit or district court name, a brief description of the case and issue, and the current status, if known.
