On August 29, 2017, the Office of Management and Budget (OMB) issued a memorandum informing the U.S. Equal Employment Opportunity Commission (EEOC) of OMB's decision to initiate a review and immediate stay of the EEOC's collection of aggregate W-2 pay and hours-worked data on the EEO-1 report. At the same time, OMB expressly permitted the EEOC to continue collecting EEO-1 data identifying the race, ethnicity, and sex of workers, by job categories.
Therefore, for the 2017 EEO-1 reporting cycle, the EEO-1 will not collect data about pay and hours worked from employers. But, for the 2017 EEO-1 reporting cycle, the EEO-1 will collect data on the race, ethnicity, and sex of workers, by job category, from private employers with 100 employees or more and federal contractors with 50 employees or more and $50,000 in contract(s).
No. The 2017 EEO-1 report must be submitted and certified by March 31, 2018.
Yes. The employment data used for the 2017 EEO-1 report should be collected using a payroll period in October, November, or December 2017, the fourth quarter of calendar year 2017. This payroll period is the 2017 "workforce snapshot period."
No. Employers should not re-submit information from the 2016 EEO-1 report. The 2017 EEO-1 report will require employers to submit new employment data on race, ethnicity, sex, by job category from a payroll period in October, November, or December 2017.
Employers will continue to file the EEO-1 report with the Joint Reporting Committee comprised of the EEOC and the OFCCP.
Consistent with current reporting practices, employers will submit EEO-1 reports securely via the EEO-1 Online Filing System on the EEOC's website or will utilize this portal to electronically transmit a data file containing the EEO-1 data.
All EEO-1 filers (those who filed EEO-1 data in the last survey cycle) will receive their annual Notification Letter indicating that the 2017 EEO-1 Survey is open with filing instructions. Information about the 2017 EEO-1 Survey Opening will also be posted on the EEO-1 Survey Webpage at www.eeoc.gov/eeo1survey.
